End User License Agreement

This EULA is a draft for future packaged Tono applications. The open-source Tono source code remains governed by the licenses distributed with that source code.

1. License to use the packaged application

Subject to the applicable distribution terms, you may install and use a packaged Tono application for lawful personal or organizational use. This EULA does not transfer ownership of Tono branding or proprietary assets that are not part of the open-source license.

2. User-supplied content

You retain responsibility for the music, recordings, videos, notation, MIDI, and other content you provide. You represent that your use of that content with Tono is permitted by applicable law and any rights or licenses that apply to it.

3. Music rights

Tono does not grant licenses to musical compositions, sound recordings, lyrics, performances, artwork, or other third-party content. Generated transcriptions, stems, backing tracks, practice videos, or recordings may remain subject to rights in the original source material.

4. Third-party components

The packaged application may include, call, or interoperate with third-party open-source components. Those components remain subject to their own licenses and notices. Where required, applicable notices and license information are provided in the Open Source Notices page or distributed documentation.

FFmpeg, where used, is a separate third-party project. FFmpeg is generally licensed under LGPL v2.1 or later, but particular builds may become subject to GPL terms if GPL components are enabled. The license of any FFmpeg binary actually distributed with a packaged Tono application must be reviewed at release time.

5. Generated output and accuracy

Automatic transcription, source separation, pitch detection, fingering generation, transposition, and synchronization may contain errors. You are responsible for reviewing output before using it for publication, instruction, or performance.

6. No automatic publishing permission

The ability to export or record a performance does not grant permission to publish copyrighted music or derived output. You remain responsible for obtaining any rights required to distribute or publicly perform the result.

7. No warranty

To the maximum extent permitted by applicable law, the packaged application is provided without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or compatibility with every device or media file.

8. Limitation of liability

To the maximum extent permitted by applicable law, Tono's authors, maintainers, contributors, distributors, and licensors will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, opportunity, or third-party claims arising from use of the application or user content.

9. Open-source reverse engineering rights

Nothing in this EULA prohibits inspection, modification, reverse engineering, or other activity to the extent expressly permitted by an applicable open-source license or by mandatory law.

10. Termination

Your rights under a packaged application's proprietary terms may terminate if you materially breach those terms, but termination does not extinguish rights that an applicable open-source license independently grants you.
